Areas of Practice-Plant Breeders' Rights
The Spoor & Fisher Plant Breeders’ Rights Department provides a holistic approach to our clients who are looking to obtain valid protection for new plant varieties in terms of the South African Plant Breeders’ Rights Act. This approach includes expertise in the preparation and filing of the Plant Breeders’ Rights applications, advice on the importation and subsequent examination of the plant variety material, experience in the field of opinions, agreements and litigation as well as a wealth of knowledge regarding the implementation of statutory protection during commercialisation of a plant variety.
All members of our Plant Breeders’ Rights team are highly qualified, enabling us to provide top quality advice and service to our local and international clients on a broad range of related issues. In addition, we have a good working relationship with the South African Department of Genetic Resources (which handles Plant Breeders’ Rights Applications). We also monitor developments very closely and are thus acutely aware of any new regulatory developments in the field, enabling us to provide the best possible advice to our valued clients.
