Basis for Registration:

International Arrangements:

None, however, special priority may be claimed of UK and EU applications, provided that the Turks & Caicos application is filed no more than 12 months after the effective date of the UK/EU application.

Although the legal basis may be open to challenge, as a British overseas territory, the Turks & Caicos Registry is, in practice, also accepting applications claiming priority under the Paris Convention by extension of the UK’s membership.

Categories of Trade Marks:

There are provisions for the registration of COLLECTIVE, CERTIFICATION, DEFENSIVE, SERIES and SERVICE MARKS.

Classification:

The International Classification of goods and services applies.

A separate application is required for each class of goods or services.

Documents required:

A. New Applications:

  • Power of Attorney, simply signed.
  • Priority document (if applicable) with verified English translation.
  • Ten prints, except for word marks in ordinary type.

B. Renewals:

  • Power of Attorney, simply signed.

An annual maintenance fee is also payable, for which no documents are required.

C. Assignments:

  • Power of Attorney, simply signed.
  • Deed of Assignment.
  • Form TM17 (Request by Registered Proprietor to Register Assignee as Subsequent Proprietor).
  • Form TM18 (Declaration from Assignee, before a Notary Public/Commissioner of Oaths).
  • Form TM19 (Request to Enter Name of Subsequent Proprietor).

D. Mergers:

  • Power of Attorney, simply signed.
  • Certificate of Merger.
  • Form TM19 (Request to Enter Name of Subsequent Proprietor).
  • Form TM20 (Declaration from Subsequent Proprietor, before a Notary Public/Commissioner of Oaths).

E. Change of Name:

  • Power of Attorney, simply signed.
  • Certificate of Change of Name.
  • Form TM24 (Request to Enter Change of Name of Registered Proprietor).

F. Change of Address:

  • Power of Attorney, simply signed.
  • Certificate of Change of Address.

G. Licences/Registered Users:

  • Power of Attorney from the licensee, simply signed.
  • Statutory Declaration.
  • Form TM36 (Application for Registration as a Registered User of a Registered Trade Mark).
