Categories of Trade Marks:

There are provisions for the registration of COLLECTIVE, SERIES and SERVICE MARKS.

There are no provisions for the registration of DEFENSIVE MARKS.

Classification:

The International Classification of goods and services applies.

A single application may cover any number of classes of goods and/or services.

Documents required:

A. New Applications

  • Power of Attorney, notarised by means of a notarial certificate (a stamp or seal is acceptable)
  • Priority document (if applicable) with verified English translation
  • Ten prints, except for word marks in ordinary type
  • An indication of whether the mark is “in use” or “proposed to be used”

B. Renewals

  • Power of Attorney, notarised by means of a notarial certificate (a stamp or seal is not acceptable)

C. Assignments/Mergers

Assignments

  • Power of Attorney, notarised by means of a notarial certificate (a stamp or seal is not acceptable)
  • Either a Deed of Assignment or other instrument of title, or;
  • Forms 9 and 10, simply signed by both parties

Mergers

  • Power of Attorney, notarised by means of a notarial certificate (a stamp or seal is not acceptable)
  • Either a Certificate of Merger or other instrument of title, or
  • Forms 9 and 10, simply signed

D. Change of Name

  • Power of Attorney, notarised by means of a notarial certificate (a stamp or seal is not acceptable)
  • Certificate of Change of Name

E. Change of Address

  • Power of Attorney, notarised by means of a notarial certificate (a stamp or seal is not acceptable)
  • Certificate of Change of Address

F. Licences/Registered Users

  • Power of Attorney, notarised by means of a notarial certificate (a stamp or seal is not acceptable)
  • Licence Agreement, notarised (optional)
