Trade Marks

The Trade Marks Act, 2013 came into force in the British Virgin Islands on 1 September 2015. The new Act replaced the Trade Marks Act (Cap.158) of 1887 and the United Kingdom Trade Marks Act (Cap.157) of 1946 and there is no longer an option for UK-based registrations. Please contact us for further information on transitional provisions.

Categories of Trade Marks 
There are provisions for the registration of SERVICE MARKS, COLLECTIVE MARKS, CERTIFICATION MARKS, SERIES MARKS and DEFENSIVE MARKS. 

Classification 
The International Classification of goods and services applies.

A single application may cover any number of classes of goods and/or services.

Documents required

A. New Applications

  • Ten prints of the mark (or one electronic specimen), including a verified English translation and/or transliteration of the mark (if applicable).
  • An indication of whether the mark is "in use" or "proposed to be used"
  • Priority document (if applicable) with verified English translation.

B. Renewals

  • No documents required.

C. Assignments/Mergers

  • Deed of Assignment or other instrument of title, with verified English translation.

D. Change of Name

  • Certificate of Change of Name, with verified English translation.

E. Change of Address

  • Certificate of Change of Address, with verified English translation.

F. Licences/Registered Users

  • Licence Agreement, with verified English translation.
