Categories of Trade Marks

There are provisions for the registration of COLLECTIVE and SERVICE MARKS.

There are no provisions for the registration of SERIES or DEFENSIVE MARKS.

Classification

The International Classification of goods and services applies.

A single application may cover any number of classes of goods and/or services.

Documents required

A. New Applications

Independent

  • Power of Attorney, notarised.
  • Declaration of Intent to Use, notarised.
  • Priority document (if applicable) with verified English translation.
  • 12 prints, except for word marks in ordinary type.

B. Renewals

  • Power of attorney, notarised.

C. Assignments/Mergers

  • Power of Attorney, notarised.
  • Deed of Assignment, signed and sealed by both parties.
  • Form 9 (application for change of ownership), notarised.
  • In the case of an assignment - Declaration Verifying Assignment, notarised.
  • In the case of a merger - Certificate of Merger, notarised.

D. Change of Name

  • Power of Attorney, notarised.
  • Affidavit of Change of Name or Certificate of Change of Name, notarised.

E. Change of Address

  • Power of Attorney, notarised.
  • Affidavit of Change of Address or Certificate of Change of Address, notarised.

F. Licences/Registered Users

  • Power of Attorney, notarised.
  • Form 9 (application for change of ownership), notarised.
  • Licence Agreement, notarised.
