Zimbabwe Adopts 8th Edition of Nice Classification and Substantially Increases Official Fees

On 19 August 2005, without prior notice, new trade mark regulations were published in Zimbabwe.

The new regulations came into effect immediately and the most important changes are:

  • the doubling of the US$ Official Fees payable by foreign applicants; and
  • the adoption of the 8th Edition of the Nice Classification of Goods and Services.

A number of issues pertaining to the transitional provisions, the reclassification of marks and the correct classification of “retail and wholesale services” must still be clarified. For the time being, we recommend that applications for “retail and wholesale services” either be delayed or, alternatively, lodged in class 35 until a ruling has been received from the Registrar.
