Southa Africa - Draft Regulations relating to the Labelling and Advertising of Foods: Amendment published for public comment

The current Regulations relating to Labelling and Advertising of Foodstuffs (No. R. 146) came into force during March 2012. Just more than two years down the line, the Department of Health has now published proposed new Regulations, which we anticipate will ultimately replace the Regulation 146. These draft Regulations were published in Government Gazette No. 37695 of 29 May 2014 as Notice R. 429 – Foodstuffs, Cosmetics and Disinfectants Act (54 / 1972): Regulations relating to the Labelling and Advertising of Foods: Amendment.

In terms of the Notice, the Minister of Health has indicated his intention to promulgate Regulation 429 and all interested persons have been invited to submit any substantiated comments or recommendations on the draft Regulations within three (3) months from the date of publication thereof. The current deadline for submitting comments on the draft Regulations (R. 429) is 29 August 2014.

The proposed Regulations are voluminous and comprise some 112 folios. Accordingly, it is not the intention of this circular to deal with any of the proposed amendments.
