Circular No 363: International (PCT) Applications - Deadline for Entering the National Phase in South Africa

In our Circular No. 361 we reported that we were waiting for our authorities to amend our Patent Regulations to bring the Chapter I deadline for entering the National Phase in South Africa into line with the amendment of PCT Article 22.

We are pleased to report that on 23 April 2003 our Patent Regulations were amended to provide that the Chapter I deadline for entering the National Phase in South Africa is 31 months from the earliest priority date of the corresponding International Patent Application.

As mentioned in our Circular No. 361, the deadline for entering the National Phase in South Africa can also be extended for a period not exceeding 3 months.

Thus, for pending International Patent Applications the Chapter I and Chapter II deadlines are now both 31 months from the earliest priority date, extensible to 34 months.
