Duties of inspector following seizure of goods:
1. Attachment of Goods - after goods have been seized the inspector must:
· forthwith seal, clearly identify and categorise the goods; (s 7(1)(a)
· prepare an inventory of the goods [for example see "J1"]; note that:
- the inventory must be in quadruplicate; (s 7(1)(a))
- the suspect must check the inventory for correctness and, if so, certify under his signature on every original of inventory (s 7(1)(a)
· endorse the inventory (with his signature) (s 7(1)(a)); noting where the goods have been removed in terms of s 7 (1)(c), the inspector must endorse that fact under his signature;
· every original of the inventory has to be endorsed.
· the endorsed inventory serves as a receipt.
· furnish one original of inventory to suspect and complainant (s 7(1)(b)); note that this has to be done within 72 hours after seizure of goods.
· remove the goods to a counterfeit goods depot or, if the goods are not capable of being transported, declare the goods to have been seized
(s 7(1)(c)); note that this must be done as soon as possible.
· a declaration must be made by the inspector where the goods are not capable of being removed or transported.
2. Written Notice by Inspector
· The inspector must inform the complainant or the person who qualifies to be complainant of action taken as well as address of counterfeit goods depot where goods are being kept (s 7(1)(d)) by way of issuing a notice to the complainant and to the suspect. (see example marked "J2")
