G. Execution of Warrant - [Section 6 Continued]  01/01/1990

  1. A warrant may be issued on any day. (s 6(3))
  2. A warrant will be in force until:

·         it has been executed;

·         it is cancelled by the judge or magistrate who issued it;

·         the expiry of three months from the date of its issue; or

·         the purpose for which the warrant was issued has ceased to exist. (s 6(3))

  1. The warrant must be executed by day unless the person issuing the warrant has authorised the execution thereof by night at times, which must be reasonable. The request for such authorisation should also be included in the inspector´s affidavit in the normal course. (s 6(4))
  2. Upon request the inspector must furnish the said person with his authority to execute the warrant. He may be requested to produce his certificate of appointment issued by the Minister in terms of Section 22(3). (s6(5)).
